Proposed CPSC e-bike battery rule: comment period closes
Is the CPSC e-bike battery safety rule (UL 2849) final?
Public comments on CPSC's proposed mandatory safety rule for micromobility lithium-ion batteries closed on August 24, 2026. The rule would make UL 2849 mandatory for e-bikes, plus added tests. It is not final yet.
CPSC approved the proposal on June 22, 2026 and published it in the Federal Register on June 24 as 16 CFR part 1265. Written comments were due August 24, 2026.
It would make UL 2849-20 (e-bike electrical systems), UL 2271-23 (replaceable battery packs) and UL 2272-24 (other e-mobility devices) mandatory. It adds requirements beyond those standards, including tamper-resistant battery enclosures, reverse-polarity tests and protection against incompatible chargers.
The rule covers e-bikes, e-scooters, hoverboards and similar products, plus replacement battery packs, aftermarket chargers and e-bike conversion kits. CPSC cites 227 battery-related micromobility incidents from 2019 to 2023, including 39 deaths and 181 injuries.
A final rule would take effect 180 days after publication and apply to products made after that date. It could preempt some state and local battery rules. We found no final rule as of October 23, 2026.
